1. Definitions

These General Terms and Conditions of Sale (hereinafter the GTCS) are those of LES TOITS DE MARSEILLE (Hôtel Amoi Vieux Port), a SAS registered in the Marseille Trade and Companies Register under number 881 598 056, whose registered office is located at 26 rue Breteuil - 13006 Marseille, France, (hereinafter the Company).

The Company owns and publishes the website: www.hotelamoimarseille.com

The site is hosted by :

OVH, a company registered with the Lille Métropole Trade and Companies Register under no. 424 761 419, whose registered office is located at 2 rue Kellermann - 59100 Roubaix (telephone: 09 72 10 10 07).

The publication director is: the management of the Hôtel Amoi Vieux-Port Marseille.

The site offers customers (hereinafter referred to as the Customer) the possibility of reserving and paying for rooms at the Hôtel Amoi Vieux-Port Marseille (hereinafter referred to as the Services).

The official language of the site is French, although an English version may exist for information purposes.

 

2. Application of the GTC

The purpose of these GTC is to define the conditions applicable to any reservation made on the site by the Customer.

Validation of a booking (hereinafter referred to as the Order) implies full and unreserved acceptance of these GCS.

Prior to placing an Order, the Customer declares that he/she has received all the necessary information concerning the Services.

 

3. Ordering services on the site

The Customer selects the desired Services on the site, which are described in detail on the associated booking pages.

The Customer may, at any time, check the details of their Order and its total price (including any additional amounts such as tourist tax).

Before final confirmation, the Customer may modify his/her Order. The summary shown includes :

  • the services selected

  • their price including VAT,

  • the associated conditions (flexible, non-cancellable, etc.).

The Order becomes definitive when the Customer :

  1. ticks the box indicating acceptance of the General Terms and Conditions, then

  2. clicks on " Confirm my booking ".

Certain " Non-cancellable, non-refundable " offers require explicit acknowledgement of the payment obligation.

Once the booking has been confirmed, the Company sends the Customer a confirmation email containing the details of the booking.

 

4. Terms of payment

The prices of the Services are quoted in euros, inclusive of all taxes.

Unless otherwise specified, additional services (breakfast, etc.) are not included.

For online payments, the site uses a security system provided by the service provider selected by the Thaïs PMS booking engine.

This system guarantees the confidentiality and protection of the Customer's bank details, which are not kept by the Company under any circumstances.

The Company reserves the right to suspend or cancel any Order in the event of :

  • non-payment

  • fraud or attempted fraud.

 

5. Group conditions

Group conditions apply to bookings of 5 rooms or more.

7. Right of withdrawal

In accordance with article L.221-28 of the French Consumer Code, accommodation services are not subject to the right of withdrawal.

By accepting these GCS, the Customer expressly waives any right of withdrawal.

 

8. Processing of personal data

In the course of its business, the Company processes personal data relating to its Customers.

The Company attaches great importance to respect for privacy and implements the necessary measures to ensure data security and confidentiality.

8.1 Data collected

The following data may be collected:

  • first and last name

  • e-mail address

  • telephone number

  • postal address

  • booking details

  • bank details (encrypted and processed by a secure service provider)

 

8.2 Purposes of processing

The data is used for :

  • reservation management

  • payment and invoicing

  • answering questions or complaints

  • site management

  • statistical analysis

  • management of requests relating to RGPD rights

  • prevention of non-payment and litigation

 

8.3 Retention period

Data is kept for the period strictly necessary for the above purposes, and for a maximum of 3 years after the last contact or booking, unless otherwise required by law.

 

8.4 Communication of data

The Company may be required to communicate certain personal data:

  • to administrative or judicial authorities,

  • to its technical service providers (host, PMS Thaïs, payment processor).

 

8.5 Technical retention (Decree 2011-219)

In accordance with the Decree of 25 February 2011, the hosting provider must retain certain information that can be used to identify the authors of content posted online, for a period of one year.

 

8.6 Customer rights

In accordance with the regulations, the Customer has the right to:

  • access,

  • rectification

  • deletion,

  • opposition,

  • to limit processing.

8.7 Cookies

Cookies may be used when using the site.

A consent banner informs users and allows them to accept or refuse cookies subject to consent (including Google Analytics).

These cookies do not contain any confidential information.

 

9. Applicable law and jurisdiction

These GTC are governed by French law.

In the event of a dispute, an amicable solution will be sought within 30 days.

Failing this, the competent jurisdiction will be that of the Company's registered office, unless otherwise stipulated by mandatory law.
